The Electoral College

This video does a nice job explaining this ghost system that, in the end, determines our president.

The Electoral College was a compromise created in order to keep slave states in place. It grants outsized influence to smaller states and thwarts the will of the majority by allowing a president to be elected despite failing to secure a majority of the popular vote. It is long past time for this anachronism to be repealed, but it is doubtful it ever will be. The simple fact is, the red states and the GOP have no desire to give up the advantage it gives them...as evidenced by the fact that despite falling short of the majority in all but one presidential election since 1990 (George W. Bush's second election in 2004), an electoral college victory handed the White House to Republicans twice in that period (Bush's first contest vs. Al Gore, and Donald Trump's 2016 election).

Maine and Nebraska have stepped up and award their electoral votes proportionally. So apparently in this regard it's a state' protected prerogative and doesn't get sideways with the courts.  Were it to spread, the college would be slowly democratized to track the popular vote, sidestepping the impossibility of an amendment to the Constitution. One can hope.
